Terms and Conditions for the Redemption of POINTX and Use of POINTX Application
The Applicant agrees to use the services in relation to the redemption of POINTX and/or POINTX Application as requested by the Applicant and approved by the Company pursuant to the details of services prescribed by the Company. The Applicant agrees to be bound by and comply with the following terms and conditions of the Terms and Conditions for the Redemption of POINTX and Use of POINTX Application (“Terms of Use”):
1. Definitions
1.1 “Application” means POINTX Application pursuant to these terms and conditions.
1.2 “Available POINTX Balance” means the Applicant’s total POINTX balance, excluding any negative points from the Applicant’s POINTX from Credit Card(s). The Available POINTX Balance is displayed in the "My POINTX" menu on the POINTX Application, SCB Connect, and applications, platforms or other channels of the Company’s business partners that offer the service to display the Available POINTX Balance.
1.3 “Bank” or “SCB” means The Siam Commercia Bank Public Company Limited including any persons appointed by the Bank.
1.4 “CardX” means Card X Company Limited
1.5 “Company” means POINTX Company Limited including any persons appointed by the Company.
1.6 “Credit Card” means the credit card issued by the Bank and/or CardX, both primary card and supplementary card, (except the Family Plus credit card and any other credit card types to be specified in the future), and which the Company prescribes such credit card to be able to use with these services.
1.7 “Cardholder” means the Applicant who is a cardholder of any types of the Credit Card which is prescribed to be able to use with this service as specified in Clause 1.6 above.
1.8 “CardX’s Service” means CardX’s products and/or services, except the Credit Card issued by CardX (as defined in Clause 1.6 above), namely Speedy Cash Cards, Speedy Loans and/or any other products and/or services of CardX to be specified in the future, and which the Company prescribes such products and/or services of CardX to be able to use with these services.
1.9 “Equipment for Transaction Execution” means computers and/or mobile phone and/or tablets and/or any other types of equipment as prescribed by the Company.
1.10 “Force Majeure” means any circumstances beyond the Bank’s control causing interruption of providing services pursuant to these terms and conditions, including resulting in disruption or information error such as the malfunction of the Bank’s computer system or communication system from malfunction of power supply or energy problem, any third party’s act, computer virus or harmful data which does not result from the Bank’s failure to maintain the computer system pursuant to the standard.
1.11 “Personal Security Code” means PIN-Personal Identification Number, fingerprint, face recognition, biometric, password for the use of Equipment for Transaction Execution, OTP – One Time Password, including any other codes in relation to the access of the use of Application regardless of the name of the services and whether the code is generated by the Company or the Applicant.
1.12 “POINTX” means the accumulated points of POINTX that the Applicant earns from (1) using services of the Company’s business partners which are the companies under SCBX Group, including using the Credit Card issued by the Bank and/or CardX which are prescribed to be able to use with this service; (2) participating in marketing campaign of the Company’s or the Company’s business partners; (3) using the services for redemption of the Company’s business partners’ accumulated points; and (4) any other cases to be prescribed by the Company in the future
1.13 “POINTX from Credit Card” means the Applicant’s accumulated points of Credit Card(s) issued by the Bank and/or CardX (except the credit card type as specified in Clause 1.6 above), and the POINTX from Credit Card is displayed the accumulated points per each Credit Card type (under the same Cardholder’s name) per each Credit Card).
1.14 “Redeemable POINTX Balance” means the amount of POINTX that can be used for each redemption transaction, which is proceeded automatically by the system and calculated by using the most beneficial method for the Applicant from the POINTX earned from other services consolidated with the POINTX from Credit Card for maximum 2 Credit Cards. The system will process based on expiration date of points, source of points, point redemption rate, and the amount of POINTX, and any negative points from the Applicant’s POINTX from Credit Card(s) are excluded from this calculation. The Redeemable POINTX Balance is displayed at the time of the redemption transaction on the channels where POINTX redemption service is available (e.g. SCB Easy Application and on any other applications, platforms, or channels provided by the Company’s business partners).
1.15 “Rewards” means the rewards specified in the Application or the catalog, posted on the website at https://www.pointx.scb/pointxcallcentercatalog (for Redemption of POINTX via Call Center), and/or any other channels as provided and/or to be prescribed by the Company in the future.
1.16 “Service Provider” means manufacturers and/or distributors and/or product owners and/or service providers directly relating to the Rewards, including goods and/or services and/or any other rewards type provided for these services.
1.17 “Transaction for the Use of Service” means instructions or transactions made through the Application, for example, redeeming POINTX for Rewards etc.
2. Use and Safe Keep of Personal Security Code, Personal Data and Devices for Transaction Execution
2.1 The Applicant shall keep the Personal Security Code and personal data confidential and not disclose or do any acts that may cause other persons to know such Personal Security Code and/or personal data.
2.2 The Applicant shall protect and keep security of Equipment for Transaction Execution at the secure place and shall take care and not allow such Equipment for Transaction Execution to be in the possession of any other persons or to be installed, amended or proceeded with any acts such as BOT program (robotic program), Remote Application (the application which it can be used for controlling Equipment for Transaction Execution from long distance through internet network), Jailbreak (the amendment of IOS operating system), Root (the amendment of Android operating system) or any other similar acts. If the Applicant allows the Equipment for Transaction Execution to be in the possession of any other person or any other person can access such Equipment for Transaction Execution or causes such Equipment for Transaction Execution to be installed, amended or proceeded with any acts as specified above, the Applicant shall be responsible for any transaction made through such Equipment for Transaction Execution.
2.3 The Applicant may change Personal Security Code at any time pursuant to the means and conditions prescribed by the Company.
2.4 If the Personal Security Code is locked or forgotten, the Applicant shall immediately proceed with actions pursuant to the procedures and means prescribed by the Company.
2.5 If the Personal Security Code is damaged, lost or stolen, the Applicant shall immediately notify and/or request for suspension of the transaction and/or request for seize or suspension of the use of Personal Security Code by contacting Call Center for POINTX at Tel. 1468 press 7. The Company will suspend the transaction and/or seize or suspend the use of the Personal Security Code immediately after the Applicant has passed the process of the account owner verification pursuant to the procedures and means prescribed by the Company. In this regard, the Applicant agrees that any transactions or the use of services through Applicant’s Personal Security Code before such seize or suspension by the Company shall be bound by the Applicant in all respects
In this regard, the Applicant agrees to be fully responsible for all costs and expenses in connection with the request for seize and/or suspension of the transaction or the use of services and/or in all respects.
Use of Application
3.1 The Applicant will be able to use the Application when the Applicant downloads the Application for installation on the Equipment for Transaction Execution through the channels and does any act according to the registration process for the use of Application as prescribed by the Company, including to agree to be bound by and comply with theses Terms of Use, and obtains an approval from the Company to be an Applicant of the Application. The Applicant shall be at least 15 years old and shall be bound by and comply with the terms and conditions for the use of the service prescribed by the Company for the use of such type of service and/or the on-screen terms and conditions for each type of transaction appeared before or during making transaction (if any). Such agreements, terms and conditions shall form integral parts of these Terms of Use, including but not limited to the Terms and Conditions for Redemption of POINTX via POINTX Application, the Terms and Conditions for Redemption of POINTX via Call Center. In the case that such agreements, terms and conditions are in conflict with these Terms of Use, the Application agrees that such agreements, terms and conditions shall prevail.
In the case that the Applicant discontinues and/or fails to complete the registration process for the use of Application as prescribed by the Company, it is considered that the Applicant failed to register for the use of Application, and in such case the Company will not collect and store any data given by the Applicant during the registration process. And such the Applicant will need to proceed the registration process for the use of Application as prescribed by the Company again.
3.2 In the case that the Applicant proceeds the registration process for use of the Application by means of giving the Applicant’s identification number and data for verifying the status of the Applicant’s identification card. The Applicant will not be able to use the certain services of the Application according to the terms and conditions specified in Clause 5.2 these Terms of Use.
In addition, the Applicant shall use the service or execute any transactions under the Application by connecting from the reliable household internet service providers and/or mobile network operators only. For efficiency and security for the use of Application by the Applicant, the Applicant agrees to update version of Application to be always up to date.
3.3 In using each type of services under the Application, the Applicant shall have to enter correct Personal Security Code and shall comply with the procedures, means and conditions for the use of services prescribed by the Company in all respects. If the Applicant enters incorrect Personal Security Code in excess of times prescribed by the Company, the system shall temporarily suspend the use of services. In this regard, the Applicant shall contact Call Center for POINTX services at Tel. 1468 press 7. The Applicant agrees that such temporary suspension shall not cancel any Transaction for the Use of Service successfully done pursuant to the procedures of each type of Application and the Applicant agrees not to claim any losses and damages from the Company in all respects.
Use of POINTX Redemption Service
4.1 The Applicant may use following POINTX redemption services via POINTX Application and/or other services to be prescribed by the Company in the future, subject to the Terms and Conditions for Redemption of POINTX via POINTX Application and pursuant to the procedures, means and conditions prescribed by the Company, for 24 hours a day or other time prescribed by the Company:
4.1.1 POINTX Redemption for Rewards
(1) The Applicant can redeem POINTX for a Reward pursuant to the amount of POINTX and conditions prescribed for such Reward redemption.
(2) In the case of E-coupon, there are 2 cases as follows.
(a) the Applicant redeems POINTX for E-coupon as Reward on the Application, the Applicant will receive an E-coupon with QR code and/or barcode via Application and to be displayed on the My coupon menu when successfully redeeming for E-coupon as Reward, and
(b) the Applicant receives privileges as E-coupon from using CardX’s Service (as defined in Clause 1.8 above), such E-coupon will be displayed on the My Coupon menu.
The Applicant shall use such QR code and/or barcode (as specified in (a) and (b) above) at stores by presenting such QR code and/or barcode to the officer/staff of merchant or Service Provider for scanning or reading such information and the Applicant shall use such QR code and/or barcode within the period as shown on the screen of the Application. In this regard, the Applicant shall use E-Coupon within the period as prescribed by the Bank and the used E-coupon is non-reusable. There are some types of E-coupon that shall be used immediately after successfully redeeming for E-coupon. The Company will inform the conditions for the use of E-coupon to the Applicant by showing on the screen of Application.
(3) In case of redemption for air-tickets, tour packages and accommodation, dinning and any other vouchers as Reward, the Applicant shall directly contact the relevant Service Provider for reservation after receiving the Reward and shall comply with terms and conditions of the travel and/or services provided by the Service Provider. In this regard, any Rewards of the air-ticket, tour package and accommodation voucher shall not include any travel/accident insurances, airport taxes, fuel costs, fees, costs and expenses or fees applied for visa and/or passport. If the Applicant does not use the travel, accommodation and/or services as redeemed for Reward regardless of any reasons, the Applicant has no right to get refund POINTX and/or any amount of money from the Company.
(4) In case of redemption for the Reward under the 1 Point Redemption/ Special Point Redemption campaign, the Applicant can redeem the POINTX from Credit Card for such Reward from the eligible Credit Card and pursuant to the amount of POINTX and conditions prescribed for such Reward redemption.
(5) The Company or the relevant Service Provider will send the Reward to the Applicant at the address provided by the Applicant at the time of executing transaction, and the Company will disclose and/or send the Applicant’s data, namely name, surname, phone number, delivery address and details of Reward to the Service Provider for the purpose of management and delivery of the Reward.
(6) The Applicant shall examine or check the Reward as to its defect or damage before accepting such Reward. The Company reserves the right to refuse exchange, return or refund any Reward or refuse payment of any compensation if the Reward has already been received by the Applicant. In case the Applicant has any dispute about any defects or damages or mistakes of the Reward, the Applicant shall contact the Service Provider directly.
The warranty relating to quality of goods and/or services which are the Rewards shall be in accordance with the terms and conditions in respect of the warranty as prescribed by each Service Provider.
(7) In case the Applicant has successfully redeemed POINTX for the Reward, should there be any shortage or version change or damage of such Reward, the Company reserves the right to replace such Reward with other Reward having similar quality and price by notifying the Applicant prior to the delivery of such replaced Reward. In this regard, the Applicant shall have the right to cancel such redemption of Reward. In the case that the Applicant chooses to cancel the Reward redemption, and the Applicant redeemed the Reward by using POINTX in full amount for such Reward redemption, the Company will refund POINTX to the Applicant in the amount equal to the amount of POINTX and source of points that the Applicant redeemed at the time of redemption for such Reward, for POINTX from Credit Card will be credited into the Applicant’s Credit Card account within 1-2 business days.
If the Applicant redeemed the Reward by using POINTX in partial amount for such Reward redemption, it shall be subject to the terms and conditions specified in Clause 4.1.3 below.
(8) The Company or the relevant Service Provider will deliver the Reward to the Applicant within 2-4 weeks from the date of successful redemption transaction on the Application, except for the case that such Reward is out of stock or under the manufacturing process, the Company or the Service Provider may deliver the Reward to the Applicant later than the said delivery period. In this regard, the Applicant shall have the right to cancel such redemption of Reward if such Reward is not yet shipped. In the case that the Applicant chooses to cancel the Reward redemption, and the Applicant redeemed the Reward by using POINTX in full amount for such Reward redemption, the Company will refund POINTX to the Applicant in the amount equal to the amount of POINTX and source of points that the Applicant redeemed at the time of redemption for such Reward, for POINTX from Credit Card will be credited into the Applicant’s Credit Card account within 1-2 business days.
If the Applicant redeemed the Reward by using POINTX in partial amount for such Reward redemption, it shall be subject to the terms and conditions specified in Clause 4.1.3 below.
(9) The Company merely provides goods and/or services which are the Rewards for the provision of redemption service of POINTX. The Company does not involve in and is not responsible for any damages, losses, delays and/or any other causes incurring from the use of Rewards or travelling, airline, accommodation and/or any services provided by any Service Providers or any persons in any respects. The Applicant may contact the Call Center for POINTX services at Tel. 1468 press 7 or directly contact the Service Provider for further inquiries. The policy for refund of goods and/or services and/or any amount of funds depends on the sole discretion of the Service Provider or the Company.
(10) The value of each Reward is inclusive of Value Added Tax/VAT (if any).
(11) In case of redemption for mileages/points of the airlines as Reward, the Applicant can redeem POINTX for miles/points of the airline in which the Applicant is the member of its mileage/point program pursuant to the amount of POINTX and conditions prescribed for such Reward redemption, and the Company will disclose and/or send the Applicant’s information given to the Company, namely name, surname, membership number and/or E-mail Address to the relevant airline for the purpose of verification of the Applicant’s information and identity, and for execution of the Reward redemption transaction. In addition, the Company will record and store such data in the customer information database of the Company for the purpose of making this transaction and the future transaction by displaying the Applicant’s information when making the next transaction for this Reward redemption.
After POINTX has been successfully redeemed for mileages/points as Reward, the Applicant will not be able to cancel the transaction and transfer such exchanged mileage/points back to POINTX in any respects. The reward redemption under the airline’s mileages/points program shall be in accordance with the terms and conditions prescribed by each airline.
If the airline’s mileages/points cannot be proceeded after the successful Reward redemption on POINTX Application, regardless of any reasons, including by reason of the incorrect and/or insufficient information given by the Applicant, the Company shall not be responsible for any damages incurred by the Applicant in any respects. However, the Applicant will receive POINTX for refund in the same amount and source of points as used by the Applicant for redeeming POINTX for the Reward, for POINTX from Credit Card will be credited into the Applicant’s Credit Card account within 1-2 business days.
(12) In case of redemption for donation as Reward, the Applicant can redeem POINTX for donation to the foundations, agencies or organizations as provided on the Application pursuant to the amount and conditions prescribed for such Reward redemption, and the Company will disclose and/or send the Applicant’s information, namely name, surname, phone number, address and details of donation to the relevant foundation, agency or organization for the purpose of donation and issuance of the donation receipt/certificate which will be delivered to the address selected by the Applicant at the time of executing the POINTX redemption transaction. In addition, the Company will record and store such data in the customer information database of the Company for the purpose of making this transaction.
(13) In case of redemption for Cashback as Reward, the Applicant can redeem POINTX for a cashback credited into the Applicant’s selected Credit Card. The Applicant shall select the Credit Card for receiving the cashback credit and make the redemption transaction on POINTX Application pursuant to the amount of POINTX or the amount of cashback credit according to the terms and conditions prescribed for such Reward redemption.
(14) In case of redemption for Point2Pay as Reward, the Applicant can redeem POINTX from the Credit Card used to purchase goods and/or services in order to receive a cashback credit to such Credit Card for the repayment of such goods and/or services. The Applicant shall select the payment transaction paid by the said Credit Card for the redemption transaction on SCB Easy Application and subsequently execute the transaction to redeem POINTX on POINTX Application pursuant to the amount of POINTX and conditions as specified in the terms and conditions prescribed for such Reward redemption.
4.1.2 POINTX Redemption for the Company’s business partners’ accumulated points or the redemption of the Company’s business partners’ accumulated points for POINTX
(1) The Applicant can redeem POINTX for transferring to accumulated points of the Company’s business partners or redeem of accumulated points of the Company’s business partners for transferring to POINTX pursuant to the amount and conditions prescribed by the Company via the POINTX Application and/or the Company’s business partner’s channel (as the case may be) opened for this service and/or any other channels to be opened for this service in the future.
(2) The Applicant can check accumulated points of the Company’s business partners in accordance with the procedures and means prescribed by the Company via the Application and/or any other electronic channels to be provided by the Company to the Applicant in the future.
In this regard, the information of accumulated points of the Company’s business partners shown herein is the information provided to the Company by the Company’s business partners, therefore, the Company may not guarantee the accuracy of such information. If the Applicant has any inquires, the Applicant shall contact the Company’s business partners directly.
4.1.3 POINTX Redemption for Payment
(1) The Applicant can redeem POINTX for payment of goods and/or services, including for payment of debt from the use of Credit Card by executing the redemption transaction on the POINTX Application and/or through SCB Easy Application in accordance with the procedure, means prescribed by the Company and according to the terms and conditions for POINTX redemption set for the redemption of POINTX via such channel, which will be shown at the transaction process, and it shall be deemed integral part of these Terms and Use.
(2) The Company is merely the service provider for POINTX redemption and provide the channels for accommodating the Applicant for redeeming POINTX for payment of goods and/or services. The Company does not involve in and is not responsible for any damages, losses, delays and/or any other causes incurring from the use of goods and/or services provided by any Service Providers, merchants or any persons in any respects. The Applicant shall have to directly contact the Service Provider or merchant for further inquiries. The policy for refund of goods and/or services and/or any amount of funds depends on the Service Provider’s or merchant’s sole discretion.
(3) The Company will disclose the Applicant’s information to the Bank (in case of redemption of POINTX via SCB Easy Application) for the purpose of POINTX redemption transaction for payment of goods and/or services. In addition, the Company and/or the Bank will record and store such data in the customer information database for the purpose of making this transaction.
4.2 The Applicant may redeem POINTX through other redemption channels as provided, including the redemption of POINTX via Call Center and/or EDC/POS and/or any other channels as provided and/or to be prescribed by the Company in the future, subject to the terms and conditions for redemption of POINTX specified for the respective channel(s) and pursuant to the procedures, means and conditions prescribed for the redemption via such respective channel(s).
Additional Conditions for Use of Application
5.1 To redeem POINTX from Credit Card and/or receive privilege from CardX’s Service
5.1.1 For the use of Application for the management and redemption service of POINTX, the Applicant shall be able to redeem only the POINTX from Credit Card with the normal Credit Card status and having the remaining balance of POINTX from such Credit Card(s) (i.e., no negative points balance). The terms and conditions relating to the card status of Credit Card and the negative balance of POINTX from Credit Card shall be subject to the terms and conditions prescribed by the Bank and/or CardX (as the case may be). The amount of POINTX from Credit Card(s), that can be used for the redemption services, will be consolidated with POINTX earned from other services, which be equal to the Available POINTX Balance to be displayed for the Applicant.
In addition, POINTX from Credit Card of the primary Cardholder and the supplementary Cardholder shall be separately accumulated and used by each Cardholder.
5.1.2 For the use of Application services to receive privileges as E-coupon, the E-coupon that the Applicant receives from using CardX’s Service (as defined in Clause 1.8 above) will be displayed on the My coupon menu in accordance with the terms and conditions specified in Clause 4.1.1 (2)(ii) and the last paragraph of these Terms of Use.
5.1.3 For the use of Application for the management and redemption service of POINTX and/or to receive privileges as E-coupon from using CardX’s Service (as specified in Clause 5.1.1 and Clause 5.1.2 above) via POINTX Application and/or other channels of the Company, including channels of the Company’s business partners as prescribed by the Company, the Company will disclose the Applicant’s identification number to the Bank and/or CardX for verifying the data relating to the Applicant’s Credit Card issued by the Bank and/or CardX and/or CardX’s Service (as defined in Clause 1.8 above) having POINTX and/or privilege as E-coupon and the number of POINTX, and the Company will receive such Applicant’s data from for the Bank and/or CardX for the purposes as specified above. In addition, the Company will record and store such data in the customer information database of the Company for the purpose of making the transaction for the Applicant.
5.2 Use of Redemption Service
In the event that the Applicant has applied for the use of Application in type of the person who does not have any of the Credit Card issued by the Bank and/or CardX and/or the Bank’s products or services and/or CardX’s Service, namely the Applicant has applied for the use of Application by means of giving the Applicant’s identification number and data for verifying the status of the Applicant’s identification, the Applicant will not be able to use the certain services prescribed by the Company, namely the services specified in Clause 4.1.1 (2)(b) (4) (11) (13) (14), Clause 4.1.3 and Clause 4.2 and any other services relating to the Credit Card issued by the Bank and/or CardX and/or the Bank’s products or services and/or CardX’s Service as prescribed by the Company.
If the Applicant wishes to use the services relating to the Credit Card issued by the Bank and/or CardX and/or the Bank’s products or services and/or CardX’s Service in the future, the Applicant shall proceed in accordance with the means and procedures via POINTX Application and/or any other electronics channels, i.e., to verify the Applicant’s identity via SCB Easy Application or to link the Applicant’s POINTX account via CardX Application (as the case may be) as prescribed by the Company before using such services.
5.3 Redemption of POINTX
5.3.1 The Applicant accepts and agrees that the redemption rate of POINTX for making the transaction under each service may be different as prescribed by the Company at each time of making a transaction, which is shown on the screen and confirmed to execute the POINTX redemption transaction by the Applicant, subject to the terms and conditions for POINTX redemption set for each redemption service shown at the transaction process, and it shall be deemed integral part of these Terms and Use.
5.3.2 The Applicant accepts and agrees that the source(s) of POINTX and the use of POINTX amount for making each redemption transaction may be different pursuant to the terms and conditions for POINTX redemption set for each redemption transaction which is shown at the transaction process, and it shall be deemed integral part of these Terms and Use.
(1) In case of the use of POINTX redemption services on the Application under Clause 4.1.1 (except the service under Clause 4.1.1 (4) - 1 Point Redemption/ Special Point Redemption and Clause 4.1.1 (14) – Point2Pay) and Clause 4.1.2 (except the POINTX Redemption for the Company’s business partners’ accumulated points via the channels of the Company’s business partners), the Applicant shall select the source of POINTX for making each redemption transaction from the POINTX earned from other services consolidated with the POINTX from Credit Card for maximum 2 Credit Cards in accordance with the procedure, means and conditions prescribed by the Company.
(2) In case of the use of POINTX redemption services via other channels as provided by the Company (e.g. SCB Easy Application or applications, platforms or other channels of the Company’s business partners), the Applicant shall use the Redeemable POINTX Balance which will be displayed at the time of the redemption transaction via such channel.
5.4 Information of Application Usage
The Applicant can check the following information on Application, namely the number of POINTX per its source(s), the Transaction for the Use of Service relating the redemption of POINTX on the Application and/or the redemption of POINTX via Call Center and/or SCB Easy Application and/or any other electronics channels to be prescribed by the Company in the future.
In this regard, the information of the POINTX from Credit Card shown for checking information as specified above is the information provided to the Company by the Bank and/or CardX, therefore, the Company may not guarantee the accuracy of such information. If the Applicant has any inquires, the Applicant shall contact the Bank and/or CardX directly.
5.5 Other conditions
5.5.1 The Applicant may earn POINTX from purchasing goods and/or using services of the Company’s business partners and the POINTX may have expiry date for usage subject to the terms and conditions for earning POINTX as prescribed by each business partner.
In case the Applicant applies for a service to view the total POINTX balance via applications, platforms or other channels of the Company’s business partners, the Company will disclose details of POINTX pursuant to the terms and conditions for using such service.
5.5.2 The Applicant may earn POINTX from participating in a marketing campaign of the Company or the Company’s business partners and POINTX may have expiry date for usage subject to the relevant marketing campaign’s terms and conditions for earning POINTX as prescribed by the Company or the Company’s business partners (as the case may be). In such case, the Applicant will be notified through the In-App Notification and can check further details of the earned POINTX on the Application.
5.5.3 The Applicant may participate in the Company’s marketing campaign provided on the Application in the form of point discount promotion for Reward redemption, e.g. Flash Deal, Double Day, Seasonal promotion etc. The conditions, including the promotion period, percent point discount, the amount of POINTX for redemption of the Reward provided for the promotion and the remaining amount of Reward under the promotion will be shown on the Banner and/or the promotion displayed bar relevant to such promotion. The Reward provided for each promotion may be changed as necessary and appropriate at the Company’s sole discretion.
5.5.4 In case of any error transaction, regardless of any reasons, which results in wrong receipt of POINTX by the Applicant, the Company shall have the right to adjust such wrong amount to the correct amount of POINTX, for POINTX from Credit Card will be credited into the Applicant’s Credit Card account within 1-2 business days.
5.5.5 POINTX has period for usage as prescribed by the Company. In case the period for usage is expired, the Applicant will not be able to use such POINTX and will not be able to request for refund of such expired POINTX, exchange or refund in any monies or any substitution.
5.5.6 The Applicant can download and install the Application on Equipment for Transaction Execution as prescribed by the Company, without limitation for number of devices. However, only one device can be used at each time to access the Application. In case of more than one device are used at the same time, the Company will allow only the latest device used for accessing the Application to use the services.
5.5.7 The Company derives the content or information in relation to Rewards from the third party. Therefore, the Company cannot represent the accuracy or completion of such content or information and does not involve in, represent or warrant any goods, services, offers, promotions and/or any benefits manufactured or provided by the third party. The Company is not responsible to the Applicant or any persons for any damages resulting from the use of such content or information and/or any other events caused by the goods and/or services in any respects.
5.5.8 The Applicant can delete the Application user account (“POINTX Account”) between 8 a.m. – 8 p.m. or any other time prescribed by the Company by deleting the Applicant’s POINTX Account pursuant to the procedures, means and conditions prescribed by the Company. However, the Applicant will not be able to delete its POINTX Account if the Applicant has a negative POINTX balance.
For the deletion of POINTX Account, the Applicant agrees as follows:
(a) If the Applicant has the remaining Available POINTX Balance and does not redeem such remaining balance before confirming the deletion of the Applicant’s POINTX Account, the Applicant accepts and agrees that the remaining number of POINTX from Credit Card will be able to redeem via other channels as specified in Clause 4.2 only and the remaining number of POINTX earned from other services will be deleted and cannot be refunded in any respect.
(b) If the Applicant has the remaining E-coupon and does not use such remaining E-coupon before confirming the deletion of POINTX Application, such remaining E-coupon will be deleted and cannot be refunded in any respect.
(c) If the Applicant redeem POINTX for Reward on the Application and such Reward has not been delivered, the Applicant will not be able to delete the Application’s POINTX Account until the Reward has been successfully delivered to the Applicant.
(d) When the Applicant successfully confirms the deletion of the POINTX Account, the Applicant will not be able to reapply for the Application 48 hours after the deletion of the Applicant’s POINTX account.
The Validity of the Use of Services or Transactions and Agreement Binding on the Applicant
6.1 Any operation in any procedures through the Application for the use of the services pursuant to these Terms of Use is reliable and enforceable between the Applicant and the Company. The Applicant represents and warrants that any documents and/or information received by the Company through such procedure is reliable, correct and true as if they were made in writing and is enforceable among the Applicant, the Company and the relevant third party in all respects. In this regard, the Company is not required to check the accuracy of information and/or any details in relation to the proceeding of Transaction for the Use of Service at each time.
6.2 The Applicant represents that any photos, documents and/or data received and/or to be received in the future by the Company from the Applicant via the Application and/or any other channels ad means as prescribed by the Company are the Applicant’s data which is correct, complete and true in all respects. The Company will collect and record such data in the Company’s customer information database for the purpose of providing the Company’s services and/or making transactions with the Company.
In case that the Company finds or suspects that any photos, documents and/or data received by the Company from the Applicant are not correct, complete or true, the Applicant agrees that the Company shall have the right to deny providing services, temporarily suspending or canceling transactions and/or the use of these services and/or other services at any time without having to notify the Applicant in advance and the Company shall not be liable to the Applicant for any losses and damages in any respects. In addition, the Applicant agrees to indemnify and hold harmless against the Company for any and all losses or damages incurred to the Company as a result of providing services to the Applicant by using or referring to such data,
6.3 Any acts, whether related to any services, made via the Application through the use of Personal Security Code pursuant to these Terms and Use shall be deemed accurate and valid and shall bind the Applicant in all respects without having the Applicant to execute and/or sign any other documents. The Applicant also agrees to be bound by such acts as if it has been done by the Applicant regardless of whether it has been done by the Applicant or any other persons and for whatever reason (except for the Company’s fault). In addition, the Applicant agrees that the use of Personal Security Code shall be deemed as the electronic signature pursuant to the law.
6.4 In case of any necessity for the benefit of the Applicant and/or for the benefit of the use of services, the Bank may require the Applicant to execute any documents in the form prescribed by the Company and/or to send any documents to the Company within a reasonable period.
6.5 The Applicant will be unable to change or withhold or cancel any transaction after such transaction has been successfully proceeded and made by the Applicant in any cases and whether such proceeding Transaction for the Use of Service has been made on POINTX Application and/or via Call Center and/or SCB Easy Application and/or any other electronics channels to be prescribed by the Company.
6.6 After the Company has already proceeded the Transaction for the Use of Service, it shall be deemed that the Company has provided the services correctly and completely and such services is binding the Applicant in all respects.
6.7 The Applicant agrees to pay the fees and service charges including any other expenses in relation to the use of these services pursuant to the rates and conditions prescribed by the Company.
6.8 The Applicant irrevocably and unconditionally agrees to indemnify and hold harmless against the Company for all losses or damages incurred to the Company and/or any persons as a result of providing services to the Applicant or proceeding Transaction for the Use of Service pursuant to these Terms and Use without the Company’s fault or in case where the Applicant uses these services for any business which is illegal or contrary to public order or good morals such as making transactions via the Application to make a payment of any debt relating to gamble, weapon trade, or supporting terrorism.
6.9 The Applicant agrees that the Company shall have the right to add, amend or modify these Terms of Use for the use of Application and relevant services, including fees, service charges and expenses in relation to the use of the services as the Company may deem appropriate. The Applicant agrees to be bound by such added, amended or modified terms and conditions, fees, service charges and/or expenses in all respects, provided that the Company will inform the Applicant by announcement at the Company’s website and/or by sending the notification in writing to the Applicant as specified in Clause 11. and/or by any other means as the Company may deem appropriate, in advance before such addition, amendment or modification take effect, except for the addition, amendment or modification which results in increasing the burden or risks to the Applicant in accordance with the Company of Thailand’s regulations, the Company shall obtain consent from the Applicant before such addition, amendment or modification.
6.10 The Applicant agrees to be bound by and comply with regulations, terms and conditions, including the Frequency Asked Questions and Tutorial posted on the website www.pointx.com, Tutorial posted on the Application and all other terms and conditions in relation to the use of Application and relevant services as prescribed by the Company, and the Applicant has acknowledge and agreed or shall be deemed to have acknowledge and agreed to the same on the application date, including those to be further prescribed, added, amended or modified which shall form integral parts of these Terms and Use.
Dealing with Error
If the Applicant is aware of any error in using the Application, the Applicant shall promptly notify the Company by contacting Call Center for POINTX at Tel. 1468 press 7, providing at least the following information: date and time of execution of Transaction for the Use of Service executed by the Applicant of the Applicant and related persons, transaction types and any information relating to the erroneous transaction as prescribed by the Company. In this regard, the Company and the Applicant shall cooperate in investigating and examining the facts and causes of error, including promptly solving such error. The Company shall inform the Applicant of the result by means and channels which the Company deems appropriate, such as, telephone, mail, E-mail or any other means or channels as specified in Clause 11 of these Terms of Use.
The Company’s Liability and the Limitation of Liability
8.1 Any acts done by the Company pursuant to these terms and conditions and/or pursuant to the use of service(s) or transaction execution(s) under these services and/or pursuant to Transaction for the Use of Service made by the Applicant and/or any terms and conditions for the use of services which are currently existing or hereafter to be further prescribed shall bind the Applicant in all respects and the Company shall not be responsible for any losses and damages incurred to the Applicant and/or any other persons in all respects, except such losses and damages incurred from the intentional fault or gross negligence of the Company.
8.2 The Company shall not have to be liable for any losses and damages incurred to the Applicant and/or any persons in all respects in case of the Applicant fails to comply with or breaches these terms and conditions or any agreements between the Applicant and the Company and/or in case of any Force Majeure events.
Suspension and/or Termination
9.1 The Company shall have the right to deny, temporarily suspend or cancel providing any and all types of services at any time by giving at least 30 days prior notice to the Applicant. If the Company deems that the Applicant fails to comply with or breaches these Terms and Use or the use of service(s) or transaction execution(s) of the Applicant may be illegal or contrary to public order or good morals or there is unusual amount of daily transaction or any abuse or wrongful use of services or the Applicant is deceased, disappeared, incompetent, quasi-incompetent, bankrupt, under temporary or absolute receivership, or over indebted or there is Force Majeure event for which a prior written notice may not be given, the Company shall have the right to refuse providing the services, to suspend or to terminate or cancel providing any or all of these services immediately, provided that the Company will notify the Applicant as soon as practicable.
9.2 Applicant accepts and agrees that the Company may need to take an action immediately to temporarily suspend or permanently terminate the Applicant’s POINTX Account at the Company’s sole discretion and without liability to the Applicant or any third party, if the Company found or suspects that the following circumstances have occurred: (a) violation of the spirit of these Terms of Use and/or any terms and conditions or contract provided for the use of point redemption services; (b) unlawful, fraudulent, harassing, defamatory, threatening or threatening behavior; (c) having multiple POINTX Accounts (d) the use of point redemption services and/or the request for return of the redeemed Reward in an unusual manner or excessive amount ; or (e) misuse of E-coupon and/or any Rewards type and/or any promotions (including but not limited to selling of E-coupon and/or any Rewards type and/or the use of any promotions of the Application in an unusual manner or excessive amount), and the Company will send the notification on the screen (Push Notification) to the Applicant for taking such action.
Collection, Use and Disclosure of Data
10.1 The Company may record any communications between the Applicant and the Company and/or store and/or record and/or process information relating to the Applicant and/or Transaction for the Use of Service and/or any acts in connection with the use of services of the Applicant for the enhancement and provision of the Company’s services, including for keeping record as an evidence for the use of services and Transaction for the Use of Service. The Applicant agrees to and shall not dispute the use of such record and/or information as an evidence against the Applicant under the laws.
10.2 For the use of the Company’s services, the Company will collect, use and disclose the Applicant’s personal data and/or any other person’s personal data provided by the Applicant to the Company to the any persons relevant to and for the purpose of providing services in accordance with these Terms and Use and any other purposes as prescribed in the Company’s Privacy Notice. To understand how the Company collects, uses and discloses personal data and the data owner’s rights in accordance with the Personal Data Protection Law, the Applicant may further read such Privacy Notice as announced by the Company on the Company’s website namely www.pointx.com and/or any other channels prescribed by the Company or to be further changed and notified to the Applicant by announcing on such website and/or any other channels prescribed by the Company. In addition, in the event that the Applicant has given any personal data of any other person, the Applicant shall notify such person of the details relating to the collection, use and disclosure of personal data and rights under such Privacy Notice.
10.3 For the benefit of the Applicant, the Company may send commercial information such as product and service information, marketing information and promotion to the electronic address such as E-mail address and mobile number and the Applicant may cancel or reject the delivery of such commercial information by toggle off the marketing consent at the menu Consent Management on Application or pursuant to the channel prescribed by the Company.
Contact Details and Notices
11.1 If the Applicant changes address, telephone number or E-mail address previously given to the Company at the time applying for the use of Application and/or proceeding any other relevant process, the Applicant shall change such information on the Application or pursuant to the procedures, process and the channels prescribed by the Company.
11.2 Any documents, letter, information or notices (“Notice”) delivered by the Company to the Applicant by the notification on Application (In-App Notification) and/or the electronics mail via the Applicant’s E-mail address (verified by the Applicant pursuant to the procedures and means proscribed by the Company) and/or the post mail at the Applicant’s default address (i.e., the default address shown in the menu Profile of the Application) and/or send the message (SMS) to the mobile phone given to the Company at the time applying for the use of Application or the latest updated contact information given by the Applicant to the Company and/or any other channels prescribed by the Company shall be deemed duly receipt by the Applicant and it shall be deemed that the Applicant shall have been duly acknowledged the Notice and the content contained therein.
Governing Law
These Terms of Use shall be governed by and construed in accordance with the laws of the Kingdom of Thailand and the court of Thailand shall have exclusive jurisdiction to adjudicate any dispute arising under or in connection with the use of the services under these Terms of Use.
